1. Acceptance of Terms

By downloading, installing, or using the Derma AI mobile application (the "App") operated by Pulse Labs ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Derma AI is an AI-powered skin analysis application that provides:

  • Skin health scoring across 9 clinical categories using AI image analysis.
  • Personalized skincare routine recommendations.
  • Product ingredient scanning and compatibility analysis.
  • Progress tracking and AI-generated insights.
  • Habit tracking correlated with skin improvements.

3. Medical Disclaimer

Derma AI is not a medical device and does not provide medical advice, diagnosis, or treatment.

  • The App's analysis is generated by artificial intelligence and is intended for informational and educational purposes only.
  • Results should not be used as a substitute for professional medical advice, diagnosis, or treatment.
  • Always consult a qualified dermatologist or healthcare provider for medical skin concerns, persistent symptoms, or before making changes to any treatment plan.
  • If you have a diagnosed skin condition (eczema, rosacea, psoriasis, etc.), continue following your healthcare provider's guidance.

4. Account Registration

  • You must be at least 13 years old to create an account and use the App.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information during registration.
  • You are responsible for all activities that occur under your account.

5. User Content

You retain ownership of all content you submit to the App, including photos and questionnaire responses ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to:

  • Process your photos through our AI analysis system to provide the service.
  • Store your data securely to enable progress tracking and personalization.
  • Generate aggregated, anonymized statistics to improve our AI models (no personally identifiable information is used).

We will never share your photos or personal data with other users, sell it to third parties, or use it for advertising.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Upload photos of other people without their consent.
  • Attempt to reverse-engineer, decompile, or extract the source code of the App or its AI models.
  • Interfere with or disrupt the App's infrastructure or other users' experience.
  • Use automated systems (bots, scrapers) to access the App.
  • Circumvent any access controls or usage limits.

7. Subscription and Payment

  • Derma AI offers both free and premium features. Premium features require a paid subscription.
  • Subscription pricing, billing cycles, and included features are displayed in the App before purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Payment is processed through Apple App Store or Google Play Store. Refund requests must be directed to the respective store.
  • We reserve the right to modify pricing with advance notice to existing subscribers.

8. Intellectual Property

The App, including its design, features, AI models, code, graphics, and content (excluding User Content), is owned by Pulse Labs and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind.
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated analysis or recommendation.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Termination

  • You may delete your account at any time through the App under Profile settings.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pulse Labs is incorporated, without regard to its conflict of law provisions.
